Use of the site www.elcia.com implies full and unconditional acceptance of the general terms and conditions for use as set forth below. These terms and conditions may be modified or added to at any time, and users of the site www.elcia.com   are therefore invited to consult them regularly.

The site is accessible to users at all times. However, www.elcia.com may decide to interrupt the service for technical maintenance reasons, and will attempt to provide users with prior warning on dates and times.

The site www.elcia.com is regularly updated by ELCIA. Similarly, these legal notices may be modified at any time: users are nevertheless required to be aware of them and are therefore invited to refer to them as often as possible.

3. Description of the services provided.

The purpose of the site www.elcia.com is to provide information concerning the full range of the company’s business activities. ELCIA attempts to provide the most accurate information possible on the site www.elcia.com However, it may not be held responsible for any omissions, inaccuracies and deficiencies in updates, whether of its own doing or that of the third parties which provide it with said information.

The content on the site www.elcia.com  is provided for information purposes only, and may change. Furthermore, the content on the site www.elcia.com  is by no means exhaustive. All information is subject to changes that may have occurred since it was placed online.

5. Intellectual property and counterfeiting.

ELCIA is the owner of the intellectual property rights or holds usage rights to all of the elements accessible on the website, in particular the text, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication, or adaptation of all or part of the website elements, irrespective of the medium or process used, is prohibited, unless previously authorised in writing by ELCIA.

Any unauthorised use of the website or any one of the elements that it contains shall be considered as constituting infringement and legal action shall be brought in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitations on liability.

ELCIA shall not be held liable for any direct or indirect harm caused to the user’s hardware when accessing the website www.elcia.com and resulting either from use of hardware that does not satisfy the specifications indicated in point 4 or the appearance of a bug or an incompatibility.

ELCIA shall also not be held liable for any indirect harm (such as, for example, loss of a contract or loss of an opportunity) following use of the website www.elcia.com.

Interactive spaces (opportunities to ask questions in the contact space) are provided for users. ELCIA reserves the right to remove, without prior notice, any content deposited in such a space which may contravene applicable laws in France, in particular provisions on data protection. Where applicable, ELCIA also reserves the right to invoke the civil and/or criminal liability of the user, in particular in cases of racist, abusive, defamatory or pornographic messages, irrespective of the medium (text, photographs, etc.).

7. Personal data management.

In France, personal data are protected by Law no. 78-87 dated 6 January 1978, Law no. 2004-801 dated 6 August 2004, Article L. 226-13 of the French Criminal Code and the European Directive dated 24 October 1995, among others.

When using the website www.elcia.com the following may be collected: the URL of the links through which the user accessed the website www.elcia.com, the user’s access provider, and the user’s Internet protocol (IP) address.

In any case, ELCIA shall only collect personal data about the user for the purpose of certain services offered by the website www.elcia.com. The user supplies such information in full knowledge of all of the considerations involved, in particular when the user enters such information personally. According to the provisions of Articles 38 et seq. of Law 78-17 dated 6 January 1978 on Information Technology, Files and Freedoms, users have the right to access, rectify and object to any personal data on them, by making a signed, written request accompanied by a copy of an identity document bearing the signature of the document holder, stipulating the address to which the response must be sent.

No personal data on users of the website www.elcia.com is published without the user’s knowledge, exchanged, transferred, assigned or sold in any way to third parties. Only if ELCIA is taken over, together with its rights, would this allow for the transfer of such information to any potential buyer who, in turn, would be bound by the same duty to conserve and modify data in respect of users of the website www.elcia.com.

The website is not declared to CNIL (the French National Information Technology and Liberties Commission) because it does not collect personal information.

The databases are protected by the provisions of the Law dated 1 July 1998 transposing Directive 96/9 dated 11 March 1996 on the Legal Protection of Databases.

8. Hypertext links and cookies.

The website www.elcia.com contains a certain number of hypertext links to other websites, integrated with the authorisation of ELCIA. However, ELCIA cannot verify the content of the websites visited in this way and therefore cannot be held liable for any consequences in this regard.

9. Applicable law and jurisdiction.

Any dispute arising in connection with use of the website www.elcia.com shall be subject to French law. Jurisdiction is awarded exclusively to the competent courts in Paris.
